What does duty of care mean? Sometimes, clients will ask me, what does duty of care mean? Really, what duty of care means is the obligation that we all owe to each other. In a premise liability case, a landowner owes a duty of reasonable care to maintain the property and to keep it reasonably safe. If a landowner or business warns of a condition, that does not allow them to escape liability, they still have the affirmative obligation to maintain that property, to keep it reasonably safe for everybody that comes to the property, whether they're a customer or a tenant.
